Limitation Of Liability

Severability

All remaining clauses or parts shall remain in full force and effect.

Dispute Resolution

The formation, interpretation, and performance of this agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Karnataka, India, without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of India. 

The state and federal courts in Karnataka, India, shall be the exclusive jurisdiction and venue for actions related to the subject matter. As a result, you submit to the personal jurisdiction of such courts. 

At this moment, you waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

Changes And Amendments

We reserve the right to modify this Agreement or its policies relating to the Website or Services at any time, effective upon posting an updated version of this Agreement on the Website. 

When we do, we will post a notification on the main page of our Website. Continued use of the Website after any such changes shall constitute your consent.

Pricing And Payment Information

All standard online payment options available on Indian e-commerce platforms (Credit/debit cards, QR Codes, and Net banking) are also guaranteed.

We strive to make available products and services at the best possible prices. Product Prices described on our Website are incorporated into these Terms by reference. 

All prices include local and/or central taxes and levies and taxes. Prices, products, and Services may change at shop.guarented.com's discretion without notice.

You agree to provide correct and accurate credit/debit card details to the approved payment gateway for availing services.

 You will not use a credit/debit card that is not lawfully owned by you, i.e. in any transaction, you must use your credit/debit card. 

In case of fraudulent card transactions, you are solely responsible for indemnifying Guarented Home Solutions for all purposes, costs, and consequences arising from it in the future.

The information you provide will not be utilized/shared with any third party unless required concerning fraud verifications by law, regulation, or court order. 

You are solely responsible for safeguarding the security and confidentiality of your credit/debit card details. 

Shop.guarented.com does not accept liability for any unauthorized use of your credit/debit card done by yourself. shop.guarented.com shall be under no liability regarding any loss/damage arising directly or indirectly from the fake authorization for any transaction for any reason whatsoever.

While availing of any of the payment method/s offered at Guarented Home Solutions. In, shop.guarented.com will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to:

  • Lack of authorization for any transaction/s and/or
  • Exceeding the preset limit mutually agreed upon by you and between your "bank/s" and/or
  • Any payment issues arising out of the transaction and/or
  • Decline of trade for any other reason/s.

Pricing/Typographical error

Suppose Guarented Home Solutions comes across any difference in pricing resulting from typographic errors concerning pricing or product information. In that case, Guarented Home Solutions shall have the right to rectify the same or cancel the order(s) and refund your money, if any, collected from the customer within 10-15 business days of such corrective action. The mode of refund will remain the same through which Guarented Home Solutions received the payment. 

In Case Of Mispricing

Despite our best efforts, there might be chances of a small number of the items in our catalog being mispriced. Though we verify prices as part of our dispatch procedures, we still:

  • Suppose an article's correct price is lower than our stated price. In that case, we charge the lower amount and send you the item. You can buy anything of the remaining amount/or take a refund of the remaining amount.
  • If a product's correct price is higher than our stated price, we will contact you to make the final decision regarding purchase at the right price.

 

Risk Of Loss

All items purchased from shop.guarented.com are made according to a shipment contract. This means the risk of loss and title for such items passes to you upon our delivery to the carrier.
